Mr. Alberto E. Lugo-Janer is a Senior attorney in the Orlando office of [CPLS, P.A.] He is a member of the Firm’s Litigation Practice Group. He also works closely with the Firm’s Class Action, Criminal Defense, Business Law, and Appellate Practice Groups.
Mr. Lugo-Janer has been involved in complex litigation for over 34 years. Prior to joining [CPLS, P.A.], he practiced law in Puerto Rico and in the Federal District and Appellate courts, including the Supreme Court of the United States. His extensive practice has included advising companies. He has litigated high-profile cases in Puerto Rico, and now principally throughout Florida, in the past three decades.
Mr. Lugo-Janer has extensive experience in state and federal courts, representing individuals as well as a wide range of businesses and companies. He handles a broad array of matters in the private and public sectors, ranging from personal injury, wrongful death, civil rights, class actions, employment discrimination, medical malpractice, criminal defense, torts, legislative lobbying, public interest law, constitutional law, appeals, and business, commercial, and real estate cases. His notable cases include multi-district mass torts, national and state class actions, and business torts involving multi-state corporations. A significant part of his practice involves contingency cases.
Mr. Lugo-Janer concentrates part of his practice on public interest class actions involving issues of constitutional law. He strives to resolve complex matters and litigate them as a last resort, for the greatest recovery achievable. He directs his practice at results in the most expeditious and economical fashion possible. He is dedicated to the protection and preservation of the rights of individuals and businesses in the face of overreaching by powerful business entities and the government.
In addition to his Juris Doctor Degree, Mr. Lugo-Janer earned a Master of Law Degree (LL.M.) at the University of Pennsylvania Law School in Philadelphia, with the grade of “excellent” in his master’s thesis on Constitutional Law.
Because of his academic qualifications and proven litigation skills, Mr. Lugo-Janer was recruited for a faculty position at the University of Puerto Rico Law School to be in charge of a Legal Aid Clinic class, where he taught civil and criminal litigation and appellate practice to his students.
Mr. Lugo-Janer has authored multiple substantive court briefs at trial and appellate levels, including briefs to the Supreme Court of the United States and the Supreme Courts of Florida and Puerto Rico. For example, the current law related to powers-of-attorney in Puerto Rico is the result of a case that Mr. Lugo-Janer brought to the Supreme Court there, and the current state of the law related to firearms in Puerto Rico is the offspring of changes that he was instrumental in implementing in the island years ago.
Similarly, in Florida, he participated as one of the attorneys in a class action that was the only one of its type that has been successful in the United States. Further, in Florida, he was ahead of his time in advocating in court for changes to the medical informed consent law, and those changes have since become the norm nationwide.
Finally, the historical and constitutional analysis that he made and the conclusions that he reached in his master’s thesis in 1982 have now, 30 years later, been adopted by the U.S. Supreme Court as the law of the land, and are now being followed and implemented by state and federal courts throughout the United States.
Pursuant to his commitment to defend our Constitutional Rights, Mr. Lugo-Janer is a Benefactor Life Member of the National Rifle Association, a member of the NRA Business Alliance, and a member of the Unified Sportsmen of Florida.
